These Terms of Use, along with our Privacy Policy, Mobile Devices Terms, and all other posted policies on our site, outline the conditions under which we grant you access to and use of our services, applications, and tools (referred to collectively as "Services"). You can review an overview of our policies here. Please note that all policies, including the Mobile Devices Terms and the Privacy Policy, are an integral part of these Terms of Use. By accessing or utilizing our Services, you agree to abide by all the aforementioned terms and conditions.

Account Creation: 

To utilize certain features of the Services, you may need to register and create an account using your phone number (referred to as "Your Account"). Your provided Phone number will serve as your account identifier, and it is your responsibility to maintain the confidentiality of your account. You are accountable for all actions carried out under Your Account, hence it's crucial to safeguard your password and ensure it's not easily guessable by others. Your Account cannot be transferred to another party without obtaining our consent.

Integration with Third-Party Services:

 You have the option to link your account to third-party services, and by doing so, you grant us authorization to retrieve, retain, and utilize your data from that service within the parameters permitted by that service and as outlined in our Privacy Policy. If you suspect any unauthorized access or misuse of your account, please reach out to Marketplix Customer Support promptly.

Utilizing the Services: 

When using the Services, ensure that you post your content in the appropriate category or section and refrain from engaging in the following prohibited activities:

• Violating any laws or our Prohibited Content Policy.
• Providing false or misleading information.
• Infringing upon the rights of any third party.
• Distributing or containing spam, chain letters, or pyramid schemes.
• Disseminating viruses or any other harmful technologies that may compromise Marketplix’s integrity or the interests of Marketplix users.
• Overloading our infrastructure unreasonably or disrupting the proper functioning of Marketplix.
• Replicating, altering, or distributing another individual's content.
• Utilizing any automated means such as robots, spiders, or scrapers to access Marketplix and extract content without obtaining our explicit written consent.
• Harvesting or gathering information about others, including email addresses, without their consent.
• Circumventing measures implemented to prevent or restrict access to Marketplix.

Misuse of Marketplix Services:

 Kindly utilize the flagging system to report any issues or offensive content, enabling us to maintain the proper functioning of our Services collectively. If we determine that users are causing disruptions or violating the principles outlined in our policies, we reserve the right to limit or terminate our Services, remove hosted content, and employ technical and legal measures to prevent users from accessing Marketplix. It's important to note that while we may take these actions or decide not to, we bear no responsibility for monitoring Marketplix or for unauthorized or unlawful content or user activity on the platform.

International Marketplace: 

In addition to the rights outlined below (refer to 'Content'), certain features of Marketplix may showcase your advertisement on affiliated sites within our global network of classifieds sites across various countries. By utilizing the Services, you consent to the display of your ads on these associated sites. While the terms governing our other sites are akin to these terms, it's important to acknowledge that you may encounter additional legal requirements or restrictions in the countries where your advertisement is published. When opting to post your ad on another site, you bear the responsibility of ensuring compliance with the policies of that particular website. We retain the right to remove your ad if it is flagged on any of our sites or if we determine that it poses issues or breaches any law or policy.

Fees and Services:

 Utilizing the Services is generally free of charge. However, there may be instances where certain Services incur fees. In such cases, you will have the opportunity to review and accept the applicable charges before proceeding. Our fees are denoted in Indian Rupee and are subject to occasional adjustments. We will inform you of any changes to our fee policy by posting such modifications on the site. Temporary fee adjustments may occur for promotional events or the introduction of new services, with notice provided at the time of announcement. Please note that our fees are non-refundable, and it is your responsibility to ensure timely payment. Failure to do so may result in limitations on your access to the Services. In the event of payment method failure or overdue accounts, we may employ alternative collection methods to recover owed fees. 

Any applicable taxes related to our Services will be collected as required by law. You agree to furnish accurate address details to enable Marketplix to fulfill its legal obligations. Should such information be lacking, Marketplix reserves the right to determine and collect the relevant taxes at its discretion. You are solely accountable for collecting and remitting any applicable taxes arising from the sale of your listed items or services on Marketplix.

 While the majority of Service features are accessible across all Marketplix websites and associated mobile applications, there may be variations in functionality depending on the specific website or mobile device utilized.

Content:

 The Services encompass materials provided by us, you, and other users, including content from our third-party service providers. By using the Services, you agree not to replicate, alter, resell, or distribute the Services, our copyrights, or trademarks. When you contribute content to us, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to utilize the copyright, publicity, and database rights associated with that content. If you suspect that your rights have been infringed upon, please inform Marketplix Customer Support, and we will conduct an investigation. We retain the authority to remove content if there are reasonable grounds to suspect a violation of these terms or the rights of any other party.

 Intellectual Property Infringements:

 To ensure compliance with intellectual property rights, refrain from sharing content that violates the rights of others, including copyright and trademark infringement (e.g., selling counterfeit goods), or featuring identifiable third parties without their consent. We may remove content if it violates our terms, policies, or any party's rights. If you believe a listing on Marketplix infringes on your intellectual property rights, report it to our customer service section. Only the owner of the intellectual property rights can report potentially infringing items or listings.

Disclaimers and Limitations of Liability:

 The Services are provided on an "as is" and "as available" basis. By using our Services, you agree not to hold us accountable for the actions or content posted by other users. Additionally, you agree not to hold us responsible for the payment processing conducted by third-party service providers (each referred to as a "Third Party Payment Processor"). If you link a Third Party Payment Processor account to your Marketplix Account, you acknowledge and agree that you are subject to the terms and conditions of that Third Party Payment Processor when making payments through Marketplix, and we bear no liability for any loss, claims, or damages arising from the services provided by that third party. Since the majority of content on our Services is contributed by users, we cannot guarantee the accuracy, completeness, effectiveness, or timeliness of any postings or user communications, nor can we guarantee the quality, safety, or legality of what is offered. Continuous or secure access to our Services cannot be guaranteed, and notification functionality may not occur in real-time due to factors beyond our control, such as delays or latency resulting from your physical location or your wireless data service provider's network.

To the extent permitted by law, we expressly disclaim all warranties, representations, and conditions, whether express or implied, including those regarding quality, merchantability, durability, fitness for a particular purpose, and those arising by statute. We are not liable for any loss, whether monetary (including profits), goodwill, or reputation, or for any special, indirect, or consequential damages arising from your use of Marketplix, even if you have informed us of the possibility of such damages or if we could reasonably foresee them. Please note that some jurisdictions may not allow the disclaimer of warranties or exclusion of damages, so these disclaimers and exclusions may not apply to you. 

Indemnification:

 You agree to indemnify and hold Marketplix, its affiliates, and our respective officers, directors, agents, and employees (each referred to as an "Indemnified Party") harmless from any claim brought by a third party. This includes any amounts payable to the third party, whether as settlement or award, as well as reasonable legal costs incurred by any of the Indemnified Parties. Such claims may arise from or relate to your use of the Services, any alleged violation of the applicable terms by you, or any alleged violation by you of any applicable law or regulation. While we reserve the right to assume the exclusive defense and control of any matter subject to your indemnification, this does not relieve you of your indemnity obligations, and we may do so at our own expense.

Personal Information: 

When you utilize our Services, you consent to the gathering, transmission, retention, and utilization of your personal data by Marketplix (referred to as the "data controller"). This information may be stored on our servers, as outlined more comprehensively in our privacy policy.

Reviews: 

During your interactions with other users on Marketplix, you may be prompted to leave a review. These reviews consist of a 1-5-star rating and selected reasons for your choice. Your submitted review, username, profile photo (if provided), and the category of the seller's listing will be made public. It's important to leave reviews in good faith, accurately reflecting your interaction with the other user. When leaving a review on another user's account, ensure that:

• It accurately represents your interaction with the other user. 
• It is not intended to harass or abuse another user.
• It is not meant to manipulate or mislead other users.

To maintain the integrity of the review system, users cannot edit or delete reviews on their own or others' profiles, and Marketplix will not intervene in review-related disputes. User reviews are the opinions of individual Marketplix users and do not represent Marketplix’s opinion.

We reserve the right to remove reviews that violate our policies or guidelines. For further details, please refer to our User Review policy.

Mobile Devices Terms:

 If you're using a Marketplix mobile application ("Application") to access the Services on a mobile device, the following terms and conditions ("Mobile Devices Terms") apply to you, in addition to the relevant Mobile Privacy and Legal Notice or End User License Agreement, as applicable. Your use of the Application signifies your acceptance of these Mobile Devices Terms.

Application Use: 

Marketplix permits you to use the Application subject to the following limitations: (a) You may not modify, copy, distribute, sell, or commercialize the Application or any associated information or software; (b) You may not rent, lease, or transfer rights to the Application; (c) You must not use the Application in a way that could harm its functionality or disrupt others' use or enjoyment of it. Additionally, you must adhere to all applicable laws and third-party agreements, such as your wireless data service agreement, when using the Application. Please note that the Application may not offer all the same features as the Marketplix website, and certain functionality may vary depending on the specific Application and/or mobile device you are using. You download and use the Application at your own discretion and risk, and you are solely responsible for any damage to your hardware device(s) or loss of data resulting from such use.

Intellectual Property – Applications:

 Marketplix holds ownership or licensing rights to all aspects of its Applications, including patents, copyrights, trade secrets, trademarks, and other proprietary rights. This encompasses all applications, renewals, extensions, and restorations thereof. You are prohibited from altering, translating, creating derivative works from, decompiling, reverse-engineering, disassembling, or attempting to extract source code from any Application. Furthermore, you must not tamper with, conceal, or modify Marketplix copyright notices, trademarks, or other proprietary rights indications that are attached to, contained within, or accessed in conjunction with any Application.
